3. Products & Availability

All products shown on the Site are made to order. While we strive for accuracy, illustrations, mockups, colours, or product images may vary slightly depending on screen settings or manufacturing variations.

We reserve the right to modify or discontinue any product without prior notice.

4. Ordering Process

By placing an order, you offer to purchase a product under these Terms.
We reserve the right to refuse any order, for example if:

  • payment is unsuccessful

  • the information provided is incorrect

  • misuse or fraud is suspected

Once the order is confirmed, you will receive an email with order details.

5. Prices & Payment

All prices include applicable VAT (where required by law).
Prices displayed at checkout are final.

We accept the payment methods shown during checkout, including but not limited to:

  • credit cards

  • PayPal

  • Shopify-supported payment options

Payment is processed immediately at checkout.

6. Shipping & Delivery

We ship europewide unless otherwise stated.

Estimated delivery times are shown at checkout but may vary depending on location, carrier delays, customs, peak seasons, or other factors outside our control.

You are responsible for providing accurate shipping details.
If a package cannot be delivered due to incorrect or incomplete information, additional shipping fees may apply.

7. Customs, Duties & Import Taxes

For international orders outside the EU, customs fees, import taxes, or duties may apply.

These charges:

  • are not included in the product price

  • are the sole responsibility of the customer

  • may vary depending on country and regulations

We are not responsible for delays caused by customs.

8. Returns, Exchanges & Refunds

Because all items are made-to-order, returns for buyer’s remorse or size exchanges are generally not accepted.

However, we offer solutions for:

8.1 Defective, damaged or misprinted items

If your product arrives damaged, misprinted, or defective, please contact us within 30 days of delivery with:

  • photos of the issue, and

  • your order number

We will replace the item at no cost if the issue is confirmed.

8.2 Lost shipments

If your order does not arrive within the expected timeframe, please contact us.
We will investigate and replace the order if the carrier confirms it as lost.

8.3 Personalised / made-to-order items

Under EU Directive 2011/83/EU, there is no right of withdrawal for goods made specifically for the consumer or produced on demand.

All Spirit Wear products fall under this category.

Therefore, the standard 14-day withdrawal period does not apply.

9. Accuracy of Billing & Account Information

You agree to provide complete, accurate, and current information for all purchases.
You must promptly update your information, including:

  • email address

  • shipping address

  • payment information

We are not responsible for failed deliveries caused by incorrect details.

10. Intellectual Property

All designs, graphics, artwork, images, texts, logos, and other content on the Site are the exclusive property of Spirit Wear or are licensed for our use.

You may not:

  • copy

  • reproduce

  • distribute

  • sell

  • modify

  • commercially use

any content from our Site without prior written permission.

Violations will result in legal action.

11. Prohibited Uses

To the maximum extent permitted by law, Spirit Wear is not liable for:

  • delays in shipping

  • customs issues and additional charges

  • indirect, incidental, or consequential damages

  • errors caused by third-party service providers (shipment, printing, etc.)

Our liability is limited to the purchase price of the product.

This does not affect your statutory consumer rights under EU law.

13. Force Majeure

We are not responsible for failure or delays caused by events outside our reasonable control, including:

  • natural disasters

  • supply chain disruptions

  • war or political instability

  • system failures

  • pandemics or transport restrictions

15. Governing Law & Jurisdiction

These Terms are governed by:

  • the laws of Germany, excluding conflict-of-law rules

  • mandatory consumer protection laws of your country of residence

If you are a consumer in the EU, you may bring legal claims:

  • in your country of residence
