Right of Withdrawal

1. Right of Withdrawal

If you are a consumer, you have the right to withdraw from this contract within fourteen (14) days without giving any reason.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, craft, or profession.

The withdrawal period expires fourteen (14) days after the day on which you, or a third party designated by you other than the carrier, acquires physical possession of the goods.

If you ordered multiple goods in one order and they are delivered separately, the withdrawal period expires fourteen (14) days after the day on which you, or a third party designated by you other than the carrier, acquires physical possession of the last item.

2. Exercising Your Right of Withdrawal

To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear statement.

You may submit your withdrawal declaration by using the electronic withdrawal button provided on our website.

If you use the electronic withdrawal button, we will confirm receipt of your withdrawal declaration without undue delay by email.

Please note that this automatic confirmation only confirms receipt of your withdrawal declaration. The validity of the withdrawal will be reviewed separately in accordance with applicable law.

To meet the withdrawal deadline, it is sufficient that you send your withdrawal declaration before the withdrawal period has expired.

3. Effects of Withdrawal

If you withdraw from this contract, we will reimburse you all payments received from you, including the costs of standard delivery.

This does not include any additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us.

We will make the reimbursement without undue delay and no later than fourteen (14) days from the day on which we receive your withdrawal declaration.

We will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you. You will not incur any fees as a result of the reimbursement.

We may withhold reimbursement until we have received the returned goods or until you have supplied evidence that you have sent back the goods, whichever occurs first.

4. Return of Goods

You must send back or hand over the goods without undue delay and in any event no later than fourteen (14) days from the day on which you informed us of your withdrawal from this contract.

The deadline is met if you send back the goods before the period of fourteen (14) days has expired.

Depending on the order and fulfillment process, we may provide a specific return address or instruct you to return the goods to a partnered fulfillment facility. Please only use a return address provided or confirmed by Spirit Wear.

Please do not return any goods to an address that has not been provided or confirmed by us.

5. Return Costs

In the case of a regular withdrawal, you bear the direct costs of returning the goods.

If the return concerns a confirmed defective, damaged, misprinted, or incorrectly fulfilled item, the matter will be handled under our separate Refund Policy and your statutory rights remain unaffected.

Where an issue is confirmed to be attributable to Spirit Wear or our fulfillment process, we will handle the replacement or refund in accordance with our Refund Policy and applicable law.

6. Loss of Value

You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

Please handle the goods with care and return them in a condition that allows proper inspection.

7. Exceptions to the Right of Withdrawal

The right of withdrawal does not apply where a statutory exception applies.

This may include, in particular:

• goods that are made to the consumer’s specifications or are clearly personalized;
• sealed goods that are not suitable for return for reasons of health protection or hygiene if they have been unsealed after delivery.

Spirit Wear products with standard designs, standard prints, standard colors, and standard sizes are not treated as personalized solely because they are produced after an order is placed.

The exclusion for personalized goods applies only where a product is expressly offered and ordered with individual customization, such as a customer-specific name, text, image, or design.

Your statutory rights in case of defective, damaged, misprinted, or incorrectly fulfilled goods remain unaffected.

8. Relationship to Our Refund Policy

This Right of Withdrawal explains your statutory withdrawal rights as a consumer.

Our separate Refund Policy explains how we handle claims concerning defective, damaged, misprinted, incorrectly fulfilled, lost, unclaimed, or incorrectly addressed orders, as well as voluntary size exchanges or goodwill-based solutions.

The statutory right of withdrawal and our Refund Policy are separate processes. Nothing in our Refund Policy limits your statutory consumer rights.

9. Model Withdrawal Form

If you wish to withdraw from the contract, you may use the electronic withdrawal button provided below. The use of this form is voluntary.

After submitting your withdrawal declaration, you will receive a confirmation of receipt by email without undue delay, containing the content of your submission as well as the date and time of transmission.
